Business Insider reported that Faruqi & Faruqi, LLP, a national securities law firm, has issued a reminder to investors of Fluence Energy, Inc. (NASDAQ: FLNC) that the deadline to pursue the role of lead plaintiff in a federal securities class action is November 30, 2026.
The complaint, filed earlier this year, alleges the company and its executives breached federal securities laws by making false or misleading statements about its ability to meet fiscal‑2026 revenue guidance. Specifically, the lawsuit claims Fluence’s revenue projections depended on new contract‑manufacturing facilities that were incomplete, non‑operational, or incapable of producing the assumed volumes.
Fluence’s stock experienced sharp declines following several earnings disclosures. After reporting Q1 2026 results on February 4, 2026, the share price dropped $10.04, a 34.63% fall, closing at $18.95. The August 5 third‑quarter release cited “we now expects” $400.0 million in project deliveries delayed to fiscal 2027, pushing the stock down another 7.17% to $13.21. A mid‑quarter guidance update on September 16 trimmed the full‑year revenue target by $0.6 billion and widened the adjusted EBITDA loss, sending the price tumbling 15.36% to $7.66.
Investors who bought or acquired FLNC securities between November 24, 2025 and September 16, 2026 and incurred losses are eligible to seek lead‑plaintiff appointment. The court‑appointed lead plaintiff must have the largest financial interest in the relief sought and be typical of the class, but participation in any recovery does not require serving in that role.
Faruqi & Faruqi encourages interested shareholders, former employees, whistleblowers, and other parties with information to contact partner James (Josh) Wilson directly at 877‑247‑4292 or 212‑983‑9330 (Ext. 1310). The firm notes it has recovered “hundreds of millions of dollars” for investors since its 1995 founding.
Why it matters: The deadline determines which investors can influence the litigation and potentially share in any recovery from alleged misrepresentations that caused significant drops in Fluence Energy’s share price.
